Update on Obama operative David "Popcorn" Kernell's sentencing and appeal process
We have it on our calendar to check on the status of David “Popcorn” Kernell’s sentencing and appeal process today. It’s been more than a month since the Media wrote a story on him, with the last mention of Kernell that we could find being on May 27, 2010 — when it was still up in the air when he’d be sentenced. The presiding judge postponed sentencing while prosecutors determined whether or not they would retry Kernell on the charge of identity theft, which the jury deadlocked on, resulting in a mistrial on that count.
Since the Media’s not going to report on the status of this Obama operative’s sentencing, we thought it would be interesting to see what all of you out there can come up with today. We bet if we all sleuthed this out, we could figure out what Kernell’s status is, and what sentencing timetable the presiding judge has in place. We do not believe this judge has the discretion to indefinitely postpone Kernell’s sentencing…and it doesn’t seem like prosecutors would have forever to decide whether they were going to retry Kernell for identity theft.
Since it’s been more than a month now since any news broke on all of this, maybe we all need to place some calls to people in Tennessee to get an update on this.
Any ideas on how to track down this information?

Somebody with access to PACER ( http://www.pacer.gov/ ) maybe able to find recent filings in the case. Sadly, that’s not me.
I have access to PACER. Here is a summary of the last document filed on 06/16/2010:
PROCEEDINGS: Motion hearing held as to defendant’s pending Motion for Judgment
and Motion for Arrest of Judgment (doc. 194). Arguments heard by counsel for Defendant
and counsel for Government. Court took matters under advisement and will issue an
opinion at a later time. Sentencing for Defendant is set for September 24, 2010 at 9:00 a.m.

It gives the defense more time to work on the judge.

Not per se, no.
First, the prosecution will have to determine if they want to retry the identity theft charge. And there’s the presentencing work.
The defense will do their presentencing work, and perhaps start on the appeals process if the the elder Kernell chooses to pay for it.
Then they all have to find a date, time and court room where the judge, the prosecutor and the defense can all meet. I’m guessing the
judge is pretty busy, as are the court rooms.

KNOXVILLE, Tenn. – A judge set a Sept. 24 sentencing date for a former University of Tennessee student convicted of hacking Sarah Palin’s Yahoo e-mail account as the Republican campaigned for vice president in 2008.
A 4-month delay allows the governmental bureaucrats to do their pre-sentencing and probation reports. And we all know how long it takes most government employees to achieve any kind of efficiency!
