Question: Do you know of any small businesses that are now going to cut staff to avoid the Rationing Bill's penalties?
Here in Boystown, we have a lot of friends who work in the bars and restaurants on and around Halsted.
Most of these small businesses have around, or just over, 50 or so employees. Only one of them currently offers healthcare to its employees — Sidetracks, which has about 65 people on staff.
The other businesses, we’ve been told, are going to start layoffs to get their staffs down to under 50 so that they don’t incur the penalties specified in the Rationing Bill.
Outside of Boystown, we also know a few printing shops, distributors, and construction companies that are also going to cut staff to avoid new taxes and fees.
Are you hearing anecdotes like this where you live?
We’re interested in seeing just how many people are going to lose their jobs — or not find future jobs because small businesses stop hiring — as a result of what Leftists did on Sunday.
Can you give us any information you are hearing?

Yes, I talked to a friend yesterday.. Her husband actually employees half American’s, half hispanics.. When he had to change his insurance, for them to GET insurance, he asked the Mexicans to buy into it, they told him NO, they get health care for free. So he has to pay 90% of the non-Mexican’s healthcare.. I told my friend, when it’s time to fire, they are the first to go.

I am not sure how many states are like that.
It’s illegal under Federal law, & under every state’s law with which I’m familiar, to take retribution against an employee based on their party affiliation or voting history.
Under at-will employment, you can terminate an employee for any non-discriminatory reason, but not so you can eliminate the Republicans from your workplace, for example.
I’m hearing about a few places and I’m worried about my own job. I work for a medical transcription company. I’ve spent 22 years of my life working toward being able to work at home and now this. I’m not sure what is going to happen…neither does the owner of the company I work for.
Get into medical billing. Medical transcription is being replaced by new software programs.
No…the voice recognition software is a bust. Most of the hospitals are switching back. I know both.
But even medical billing may be on the way out. EMR (electronic medical records) will be up and running by 2014. This puts many billers’ jobs at risk.
EMR has nothing to do with billing. It’s just a way to maintain patients’ records.
Are you sure? When DH comes home, I’ll ask him about it, but he said once our EMR system is up and running, he and the nurse will be coding and there will be no need for our biller. (I could be completely wrong – I just do his accounts payable).
Neither MT nor MB will be able to be done by machines anytime in the near future. As powerful as computers are today, and as good as voice recognition software has become, MT and MB must be performed by human beings.
In addition, both of these fields are expected to keep growing, with or without Obamacare, even in a depressed economy.
Of course, if the country goes bankrupt, all bets are off.

They are not small business but Saks Fifth here in Portland OR is closing next month…and i dont think its because of obamacare either but mainly the economy. My husband is a surgeon in town and they will no longer accept medicare patients.Their office doesnt employ a lot of people so i hope everyone still get to keep their jobs.

And yet we “old people” are yelled at for being on Medicare, when we aren’t allowed anything else. Love it. Just love it. Hubby and I pay $500 a month for Part B and State Farm supplemental. Next time I am in town, I’m going to go by the accounting office and the hospital to clarify if and how I can read on the billing (through CMS records/summaries) the difference between their actual cost and what medicare pays. I’m wondering if we might have the potential for determining how much they are being ripped off by accepting Medicare and then gifting that to the hospital either every month (whenever there’s billing–we seldom go to the doctor) or once a year or something.
We’ve already talked about just cancelling our Part B and Supplemental when the docs discontinue serving medicare and using the cash to pay “fee for service” and then plan on paying the fine. The problem I see with that (for anyone of any age) is that we might be real brave and think we’re real smart when we first do it, but there’s nothing to prevent them for raising the fine a couple of thousand dollars if they see a high number of people making that choice. You can’t negotiate with liars….or “outsmart” them.
Emma you might consider finding a doctor who takes monthly fees, as I stated below(somewhere) for office visits.

Emma, as someone who used to work for Medicare, I can tell you that Hospitals make a LOT of billing errors. It would be difficult at best to try to figure out what a Hospital’s actual cost would be. A Doctor would be better able to tell you what the actual cost of doing business is. Unfortunately, Dr.s and Hospitals feel that they have to “overbill” in order to hopefully get their reimbursement rates adjusted…every 3 years if memory serves me correctly. Many Docs will likely go to a fee for service, and let you file the paperwork to be reimbursed.
Emma, I’m not sure if I’m right but someone on a post said that they tried to cancel medicare and were told that if they did, they could not get their Social Security. I would check first.

My DH is a family physician and we employ 3 people. Things are pretty tight already and we aren’t sure how this bill will affect us. I work there for free (lucky him).
I thought it was against the law to turn away medicare patients. DH isn’t home (he runs a free clinic) so I can’t ask him, but I thought that was the case.
I think it’s just that if you take one medicare patient you have to take all patients on medicare..not all doctors even take medicare/medicaid..
I know when I had my second child the hospital billed our insurance for an epidural and the insurance paid for it. Trust me I didn’t have an epidural and being the honest person I try to be I called to take care of it..the person said “Are you sure you didn’t have an epidural??” Duh would I not know? This sort of stuff happens all the time too.

Although according to Mark Levin this afternoon, they did shoot themselves in the foot by failing to provide funding in the bill for all the added oversights/collections/threat agents that they have said the IRS should handle. They forgot to include the money to do it. So Levin was saying that it might be possible to stop the developments in that area by filibustering the appropriations bills that will be required.
That is what earlier today I urged the offices of Reps. Boehner, Ryan, Cantor, Bachmann, and Sen. DeMint, to do.

CBS news was doing it’s usual propoganda piece about how great this health care bill will be for employers.
But they had a guy with like 120 employees, and if he paid the fine instead of paying for insurance, he’d save $380,000.
The man said he’d NEVER drop insurance for his employees.
All I could think was, “Yeah, RIIIIGHT”.
This will happen nationwide. Employers will either fire employees so that they fit into the group that gets tax credits, or they’ll drop the employee insurance all together and pay the fine.

Robert Wexler retired so we will see who will run in his place on the Democratic ticket. An acquaintance of ours is running for that seat and even though he is not in my district and I did not like his using Scott Brown’s line “it’s the people’s seat” when he won the primary, I will support him. Here in Killeen Texas, there are many Day Care providers with a average of 15 staff members(mostly women). Most of these women are military wives that collect their husbands’ insurance. There is still a small percentage of employees that have no insurance. These employees will be former employees in 2011 and 2012.
I have my own business but I wont try to expand into anything bigger than just me.

We have a small business and it is likely we will be keeping it small. We cannot afford to hire anybody and it’s a shame because we have the work, we just already get hit with the 4.80 cents per person, per hour, for state L&I. That’s 40 bucks a day per person in mandated insurance. On top of that we have to pay mandated liability insurance to be in construction. Now if we hire any more people we’ll be required to add a third layer of insurance.
What’s with that anyway? You have one insurance for when you’re on the job, another for when your in a car, another in case you get hurt in construction, another policy in case somebody gets hurt in your home, and now they want us to have mandatory medical insurance? Most people are already insured in half a dozen ways it just hardly ever pays off.
Reagan alerted us about this. Once the government runs health, it can run anything. The only way to stop socialism now is getting Congress and White House. And it looks like we gonna get it.

They’ve put fixes in the senate fix bill that will give Sebelius the power to set prices for the insurance company and the thinking is that she will raise premiums for private insurance…which will force everyone to go with the government plan thus creating a single payer system.
But you have to remember that this is only if the world is perfect with butterflies and unicorns which…we know won’t happen…I’m convinced it will become a disaster long before they can implement most of it and we will be able to repeal most if not all of it.

Our first disaster, which I believe starts this year is 31 million free customers running into doctors offices demanding service. THAT in itself will crash the system this year.
2nd disater – doctors WILL leave the medical world. The lowest malpractice insurance is around 150,000/yr. If the doctor is over 50 years old, which at leat 40% are or soon will be, have no benefit to stress themselves out to comply with this bs.

I’m concerned about the union involvement in this. SEIU wants to expand internationally. If SEIU has its sights on India and starts importing foreign doctors thru a union to replace all our doctors (which has been happening…I’d say at least half our doctors now in the US are foreign), putting minorities in the medical schools working at lower pay, that is not an unrealistic scenario. The transcription business has been fighting overseas contractors for 10 years now. They work cheap but their quality of work is horrible so we have thus far been able to hold them off. The voice recognition software is not a threat. It doesn’t work well and plus the hospitals and doctors are not going to be upgrading to huge expensive computer systems anytime soon. But no doubt the delivery of medical care is about to change drastically and people are not going to like it.
Is your malpractice quote a typo? My husband is a family physician and we pay $12,500 a year in malpractice insurance. It really depends on the specialty.
I know some lawyers that pay over $100,000/yr for malpractice, so the figure she quoted for doctors may be correct.
Again, it really depends on the specialty. I don’t mean to mince words, but a family physician’s malpractice isn’t $150,000 a year – we are at $12,500 a year (which I find ridiculous). Perhaps a surgeon or gynocologist’s is, but not all doctors are that high.
Well, I’m in Chicago so pricing goes by location. Big cities would pay much more and right, specialty is everything.
I believe Anesthesiologist are the highest. If they quit – yowza..let’s make sure piglosi is the first on the list for surgery
Oncologist friend told me about 7 years ago her malpractice was around $50,000.00
I knew an ER doctor personally in CA 10 years ago who said that she paid 30,000 a year.
Speciality really plays into that.
FYI – The malpractice premiums depend on specialty and location and level of coverage.
The private insurance industry will collapse.. that is their plan. When it does, I will NOT buy into the govt.plan. We’ll find ‘back-room’ doctors who will take cash or go back to the barter system, because by that time, the dollar will be worthless anyway.
As I stated I was in the medical field. However, I am a firm believer in acupuncture.

I was thinking this today – I’ve never been a large hillary fan – okay, well, I used to be, then I wasn’t – but I have spoken to many people who have met her. Many people who completely disagree with whatever she stands for. And those people have had great things to say about her – how she does her homework, how she knows what she is talking about, etc. She would never have allowed pelosi to do what she did. She might have fought for a health care bill – but she wouldn’t have disregarded the entire country, nor would she allow the congress to be such idiots.
All my opinion, I have of course, never spoken with her.
Hillary is certainly out of the question for me. She is a Democrat & had she been in the Senate or held a congressional office during this healthcare debacle she would have gone right along and probably helped lead the charge.

Yes, I do. My daughter-in-law in Salt Lake City, Utah has a commercial painting business. She will make her decision within the next week to either close the business, try to sell, or else be forced to lay off people.
She also told me that several medium to large businesses (contractors) that she regularly does business with have already layed off people – on Monday morning…over 1,000 workers.
She also said that she has lost three contracts for painting hospitals (they were multiyear contracts that shouldn’t have ended for another nine years!) that would have provided work for her employees but the healthcare bill now only allows the government to approve hospital construction. Therefore, the largest contractor that builds hospitals throughout the US has been forced to end that part of his business. By the way, he will lay off the employees he does have when current work is completed for that portion of his business. Ironically enough, that contractor built the new Cook County Hospital in Chicago and my daughter-in-law’s business painted it. Even more ironic is that she hired “recovering” gang members from Chicago and one of them currently is her supervisor for the hospital painting jobs. I guess the “progressives” really care about minorities, huh?
I forgot to mention that she provides “cadillac” insurance benefits to her employees but she has already told them that those benefits will end. It would be cheaper for her to pay the penalties than provide the benefits. Also, over half of her employees are either Latino, Black, or re-trained homeless that she recruited from the local homeless shelter back in the days when it was nearly impossible to find workers. She assisted the Latinos to get green cards before they were hired so that she would not be one of the “evil” employers that hires illegals. The Blacks came either from the ghetto of Chicago or from New Orleans after the Katrina hurricane. And she did it all without any government “assistance” but rather on her own along with other fellow contractors.
It’s sad to see the days of ordinary people helping others!
Your daughter-in-law is an example of America operating as it was intended. People helping people. REAL help – a hand UP – for minorities and homeless and other folks who need a helping hand. The government only offers handouts, which are as addictive as crack it seems.

They will be let go at the end of April
And then there will be most likely 1 full time employee that will be let go, as her revenues are shrinking, and she cannot maintain her margins enough to maintain the busienss.
She knows she will have to file for bankcruptcy by this time next year.

My husband has 5 associates who work for him in a commission-based business. Everyone buys their own health insurance like we do. (I’ve never had employer-based health insurance, and it’s been about 23 years since my husband had any.) It’s not a typical “employee” situation– all are free associates. They work for him simply to be under the umbrella of the franchise he bought and owns, to work out of the office he leases, furnishes and equips, and to receive coaching and help from him out of his experience in growing their own piece of the business. That’s the arrangement everyone signs up for, in order to have the opportunity to reach for the sky on their own efforts. They approach him about the opportunity– it’s not like we’re taking advantage of them! It’s just mutually beneficial. Yet if we’re forced to buy insurance for the 5 of them as “employees”, there’s no way the business can stay afloat at this stage. I don’t know what’s going to happen. I suppose we’ll be forced to re-structure compensation so that they’ll have to take OUR choice of health insurance and have it deducted from commissions, just to please the federal government… or leave. Yuck! Who wants that? How stupid.

I’ve heard of a few business owners who are scared to death of what is coming because of the passing of HCR. The problem is, they don’t know, and the corrupt Dems who voted for it don’t even know what they voted on. Insane.
HillBuzz Boyz, I suggest you ask folks in the healthcare industry directly what is happening in medical practices, hospitals, etc. in light of this new legislation. I’ve posted here before about my husband’s suburban medical practice (300 employees, 25 doctors). They are very nervous about what is to come and things are starting to be affected already! They undoubtedly will begin (very soon) to cut back on the amount of Medicare patients that they see.
We are just beginning to see the horrors of full-blown socialism here and I’m praying that the conservatives (not Republicans….Conservatives!) will guide this country back to a free Republic.

I imagine docs are going to drop Medicare and Medicaid patients at a huge rate.
And there will be many doctors will ask to be paid directly, they will not accept insurance at all.
I know there are many practives in NYC that do this, they don’t accept any insurance, no medicare, no medicaid, just straight cash.
And from what I have seen they provide excellent service.
My doctor doesn’t accept insurance. A patient is free to submit the claims, but they won’t do it. The new insurance company my employer went with doesn’t have my doctor on the list so I automatically have to pay 50%.
I could look for another doctor but I sort of like the spirit of this practice. . .they told them all to go to hell years ago.
This is an excellent way of service. It’s basically limited to family practioners for obvious reasons.
I know of a lot of doctors who have already opted for monthly patient plans. Meaning, a patient, in his/her group shall pay a monthly fee can see the doctor anytime.
As for surgical patients. That’s a plan I can’t figure out. If you’re wealthy you can easily pay 1/3 of the bill and the hospital will accept it as full payment. Always was that way and always will be that way.

I think one thing this past weekend did for all of is provide that transition from dreading what was going to happen: it’s over. The bad thing happened. We don’t have to be afraid now. We will be very, very, very, very focused, angry, creative and on the hunt.
I’m making a prediction that a lot of the medical doctors will be replaced with foreign doctors and students. That’s actually been happening a few years now. We have many, many foreign doctors who come over on visas. They will work for a lot cheaper. They are also using nurses and PAs more. I’m seeing this, too.
My husband loves bringing students in and allowing them to shadow him while he works. (This is mostly high school kids who are trying to decide if they want to go into the medical field).
He told me the other day that he doesn’t feel right encouraging kids to go into the medical field anymore. His first love is medicine, but the stress on him is ridiculous lately with all of this new law being unknown.
The Dutch health-care system is typified by general shortages of doctors and other professionals, and in additiona these various professions have very high percentages of foreigners.
The doctors should refuse Medicaid!!

I just spoke to a friend in Washington State whose husband was ordered to lay off six employees because of Obamacare. This can’t be an isolated event.
This is an excellent thread. I hope everyone who is a small business owner will share their story with their elected officials and/or send a letter to your local paper. This is the first-hand, personal, reality-based fact of how this pie-in-the-sky bill will impact the lives of Americans.
sarc/ and what, pray tell, makes you think that anyone will care…local papers, unfortunately, are a big, big part of the main stream media. They don’t rock the boat much as far as I can see.
We are still waiting to see if it will affect us or not. Our library employs two part-time staff: one 20 hrs, one 10 hrs. If we understand the bill correctly, they would be counted as one person and the college would have to pay a fine for not insuring them. We also have about 30 student workers, max 10 hrs each. So another 15 part-timers if they get counted. I suspect that the university will eliminate all part-time and student worker positions. They’re not about to insure them, and I don’t see them being willing to pay $750 per person to keep them employed.
We also know that the lowest tier of our health care plan costs way more than the penalty for not providing insurance. Even if they raise the penalty to $3000, the penalty is still cheaper. So you can guess where I’m going with this.

I talked today to two restaurant owners who are planning to close when or before this goes into effect – they just can’t afford to pay either the fee or the insurance and still meet operating costs in this economy!
A couple I know who are both pediatricians have also already said that they’re looking at early retirement as soon as they get the upcoming weddings paid off for their two children.
I told my dog’s vet I was going to him for my health care.
First thing he did was check to see why I was scratching behind my ear.

I think you’re using a bit of hyperbole. There are some solid Republicans like Michelle Bachmann, Mike Pence, Paul Ryan, Jim DeMint, etc… who have been fighting this every step of the way, and are leading the repeal movement. Another GOP congressman introduced legislation to include all of Congress in the bill last year, but of course the Donks voted against it. So I think you’re tarring them with the same brush unfairly.

Okay . . . so somebody explain to me .. . if all those small businesses are gonna be laying people off, and they can’t find jobs because other small businesses aren’t going to be hiring, then, that means less $$ flowing in to pay taxes as revenues for the govt. to pay for this so-called health care. So, this actually results in less $$$ being paid into taxes because the way this health care plan is structured is just too punitive.

I have friends in Canada. They pay 3 times what we pay for many of their foods, last I asked their gas was 6 bucks. The list goes on…

I haven’t been in the working world for several year because I tend to an elderly parent with dementia and have a wonderful husband that allows me to do so.
While the company he works for (a small business) gives him free health care (meaning he draws less wages in exchange for the coverage – NOTHING is free) and they also pay a portion of my coverage, we have serious concerns. They do contract work for some prominent insurance industries (which will probably be the last to collapse)as well as smaller health care facilities.
Oh well, I guess if the economy as a whole collapses any more than it already has, we will do what they did back in the good old days and barter our services and take care of each other.
We try to keep our cabinets and freezer as full as possible, as well as a good supply of ammo. I hope it doesn’t get to that point, but I’ll do what I must to take care of my family.
And for fun, we’ve taken to some serious gardening so that we have an ample supply of veggies. Tired of paying over a dollar for a small tomato or a small onion. I’d rather grow my own…. and it gives me something to smile about
The simple answer to your question is yes. I cannot operate my business on less than 50 people. However, I can sell 1/2 of the corporation to my wife as a subsidiary. Two intertwined companies under two corporate banners each employing 45 people. In addition, every tax increase on the company (Sub Chapter corp) will be paid for from the current payroll expenditures. This means my accountant will now estimate the tax change impact as a whole figure based on projected revenues. I will translate that to a percentage of profits and then apply said percentage to a deflationary wage. I will cut the payroll by the amount of new taxation to maintain my current profit margin. In addition for FY 2010 I will not defer any income or liabilities into FY 2011 thereby taking maximum tax benefit in this year. This will reduce my revenues significantly next year (2011) and will dramatically decrease the tax liabilities next year. I know multiple business owners large and small doing the same. This “may” create a significant drop in tax revenues to federal government at the same time their expenditures will increase creating greater fiscal crisis and prolonging the recession. Currently all capital equipment is underutilized and we have 20% production capacity still available. So we will not spend on any capital equipment. However, to take maximum benefit of the “jobs bill” incentives for capital expenditures, I will buy my wife and kids new cars. Establishing them as fleet vehicles I will depreciate their cost 100% in first year and use eliminate capital gains taxes by using share equity. Obama was an idiot for not phasing in the tax increases over time. By announcing the increases EVERYONE will adjust their assets and incomes in a similar nature. Come 2011 (the year before the election) things are going to be ugly.

I just worked my first ‘contract’ job in 10 months. My employer is going all contract work to avoid benefits…I think this is what will happen. Smart business will use more temporary and contract workers and avoid this hit on their profits.

I agree with you on the 1099-contractor issue. I think more and more business will hire independents. I’ve been seeing it already. Heck, I’ve picked up personal consulting jobs that never existed before. If any of the Buzzers are good financial types you might consider doing small business book keeping from home. Or some small businesses will lease you the space inside their company to do it. You’d be surprised how many are talking about this now.
And I’ll bet when you do need more medical care, you’ll shop around when possible, and read your bills carefully. When you’re conscious that you’re spending your own money, that’s what you do. Common sense. So much gets inflated or hidden in bills, but the federal government is NOT a good level on which to ferret this waste out. Sweeping bureaucratic regulations begging to be gamed, and bureaucrats deciding who gets what with no consideration of individual needs? No way. But individuals making choices fpr themselves? That works.
Over a year ago, we started the practice of talking to the coding/billing clerks at our medical clinic before we saw the doctors so that we could see what the charges were for various procedures–even if we just in for something simple (or like antibiotics for strep throat or something),…….talk about flip out!!! You’d have thought we asked them disrobe in the waiting room.
I just pointed out to them that I didn’t do any shopping anywhere else where I didn’t know the prices before I selected my purchases and I would like to have the same privilege with regard to my medical care.
We never got very far in practical terms, but it was just my little way of serving up notice that I would like to make intelligent choices and that requires some information.
I suggest that everyone who loses a job as a result of Obamacare take their tents and park them outside of the White House. When they need medical care, they need to go to the Capitol building and tell the staff there that since they were promised healthcare every bit as good as that of Congress members, they want to be seen by the medical staff on call at the Capitol building.
After all, you have been paying their salaries for years – the least they can do is to take a few minutes to check out what is wrong with you. Oh, and be sure and take advantage of those free medications that Congresscritters get, too!

My husband is his own small business…he works alone and if he needs help he hires a young guy (since mostly guys like to work on cars) and pays him hourly/cash.. He has been doing pretty good lately as most people do not have the funds to buy a new car so they are fixing up their old cars as best they can…he is a mechanic…used to work in the car dealers but didn’t like how they ripped people off (a lot like the government) so he went to work on his own.
P.S. The neighbor is a pacifist Obama-lover and they don’t like the US flag, etc…so I got myself a flag and a flagpole..for now I have my 3×5 DONT TREAD ON ME flag hanging out..just so she’ll know where I stand. I can’t stand her anyway..
Hehehe, I get so many ideas here, I should wave one of those flags in front of Patty Murray’s office when she comes back to visit her home state.

In our daily email at work today from the trust department (I work at a bank), the advisor remarked that apparently on McDonalds recent earnings call, they had stated that it will now cost an additional $75,000+ to run a franchise. Massive company, but “70 percent of McDonald’s restaurants around the world are owned and operated by independent local businesspeople” (from their website).
Imagine how many layoffs and/or cut hours are going to result from that.

This thread is terribly sad. It’s bad enough that Americans have witnessed their neighbors losing their homes and their jobs. Now reading the comments from small business owners that will be FORCED to lay off their workers just sickens me. It’s obvious that most of the commenters here care about their workers and don’t want to cause such hardships for others.
The idiots in DC never thought about the consequences of their idiocy. They just pat themselves on the back and smirk and say “everyone has medical insurance now”. Americans may not have homes or jobs or doctors to go to, but Great Merciful Zeus! They’ll have insurance!

They DO know what they are doing. They are going to tell you: oh, we are TRYING to do better – we are doing the best we can. It’s those evil corporations and insurance companies. There there, dear. We are trying, but I guess we have to try harder. I guess we HAVE TO push single payer. We HAVE TO have a govt takeover of the whole medical system. Otherwise, well, it will just get worse. See how much worse it got after we passed that great bill? Well, wouldn’t it have been MUCH worse if we hadn’t?

I work for a small company which employs approximately 50 people. We will plan to stay under 50 employees, either by using independent contractors or paring down our staff. It’s my understanding that companies employing less than 50 are unaffected while those with 50+ will have to pay at least $750 per employee (this fine may increase if everyone opts to pay rather than insure their employees). That’s at least $37,500 – considerably more than our profit to date this year!!! They are out of their freaking minds. This will kill an already weak recovery.
